Is Chapter 7 Bankruptcy Right for Me?

In a Chapter 7 bankruptcy, all of your unsecured debts will be discharged, including credit card debt, medical bills and other similar debt. In order to qualify for Chapter 7, you must pass the means test, which takes into account your income and expenses. I will help you crunch the numbers and determine whether you are eligible to file for Chapter 7.

In Chapter 7, you must disclose all of your assets, including your home, cars and other belongings. The bankruptcy trustee will examine your assets to see if any of them can be sold to pay your creditors. The majority of people filing bankruptcy in Utah find that most of their assets are exempt from liquidation under the Bankruptcy Code.

Immediately upon filing bankruptcy, the automatic stay goes into effect, which stops creditors from trying to collect from you. They can no longer call you, garnish your wages or bank accounts, and all foreclosure and repossession actions must stop.

During your free phone consultation, I will learn as much as I can about your financial circumstances and your goals. I will also assess whether you qualify for Chapter 7 bankruptcy or whether Chapter 13 may be a better option for you.
